By engaging Khartek LLC ("Khartek," "we," "us") for managed IT, cybersecurity, cloud, or related services, or by using this website, you agree to these Terms & Conditions. If you do not agree, please do not use our services or this site.

Services

Khartek provides managed IT infrastructure, cybersecurity monitoring, cloud architecture, and helpdesk support to business clients under separately executed Service Agreements or Statements of Work. These Terms govern general use of this website and our public-facing communications; the specific scope, pricing, and service levels for any engagement are governed by the signed agreement between Khartek and the client, which takes precedence over this page in case of conflict.

User Responsibilities

Users of this website agree not to misuse it — including attempting unauthorized access, introducing malicious code, or submitting false information through our contact or scheduling forms. Clients engaging Khartek's services agree to provide accurate information necessary to deliver those services and to use them in compliance with applicable law.

Subscription and Payment

Service fees, billing cycles, and payment terms are defined in each client's individual Service Agreement, not on this website. Late payment, service suspension, and termination terms are likewise governed by that agreement.

Data Privacy

Our handling of personal and business data — including data processed while delivering IT and security services — is described in our Privacy Policy. For clients subject to HIPAA, a signed Business Associate Agreement (BAA) governs the handling of Protected Health Information (PHI), separately from this website's Terms.

Limitation of Liability

Khartek provides services on a professional, good-faith basis but does not guarantee that any system will be entirely free of security incidents, downtime, or data loss. To the maximum extent permitted by law, Khartek's liability for any claim arising from services is limited to the fees paid by the client for the specific service giving rise to the claim in the preceding 12 months, except where such limitation is prohibited by law or contradicted by a signed Service Agreement.

Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Continued use of our website or services after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
